The Charter of Fundamental Rights of the European Union and the Treaty on the Functioning of the European Union (EU) confer on everyone the right to the protection of personal data concerning them. The REGULATION OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (EU)2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR) was adopted for ensuring this right.
Although the objectives and principles of Directive 95/46/EC, on which is also based Act No. 101/2000 Coll. (on personal data protection) of the Czech Republic, still apply, this did not prevent the fragmentation in the implementation of data protection across the EU, legal uncertainty or the widespread public perception that there are significant risks in relation to the protection of individuals, in particular with regard to online IT activities. The rights of individuals to protect their personal data are significantly strengthened by the new Regulation.
